Terms of Service

These Terms of Service ("Terms") govern your access to and use of shopcardboard.com and our related services (the "Site"), operated by Joy Holdings LLC, doing business as CardBoard ("CardBoard", "we", "us", or "our"). Please also read our Privacy Policy, which is part of these Terms.

1. Who we are and acceptance

The Site is operated by Joy Holdings LLC, doing business as CardBoard. By accessing the Site, placing an order, buying a break spot, or joining our email list, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order or buy into a break. If you are a minor, you may use the Site only with the involvement of a parent or legal guardian who agrees to these Terms.

3. Products, descriptions, and pricing

We sell single trading cards (raw and graded), spots in live group breaks, and links to third-party supplies. We photograph and describe cards as honestly as we can. Colors vary from screen to screen, and any condition note is our good-faith assessment, not a grading guarantee unless a card is described as professionally graded.

Most single cards are one-of-a-kind inventory: once sold, they are gone. Prices are in US dollars and may change at any time before you order. We may correct errors in pricing or descriptions and may cancel affected orders, even after they are placed.

4. Orders and payment

Payments are processed by Shopify Payments and its payment partners. We do not receive or store your full card number. Placing an order is an offer to buy, which we may accept or decline, and we may limit quantities. Applicable sales tax is added at checkout where required. Title and risk of loss pass to you when we hand the package to the carrier.

5. Live breaks

A break is a live event where we open sealed card product and buyers purchase spots (a team, a random slot, a base spot, or a player) before it is opened. When you buy a spot, you receive the cards tied to that spot from that specific break.

Breaks are entertainment. Outcomes are variable and depend on what is pulled from the sealed product. We do not guarantee that the cards you receive will equal or exceed what you paid for your spot. Please do not buy a break spot as an investment.

Once a break has started, meaning the first pack has been opened, or once a spot has been randomized, spot purchases are final and non-refundable. If a break is canceled before it starts, we will refund affected spots.

We ship the cards from your spot according to the break listing. Some breaks ship only hits, chrome, and rookies rather than common base cards, and the listing tells you what ships. We rip every break live so you can watch each pull.

6. Shipping

We ship within the United States. We aim to send orders quickly and pack them carefully. Delivery times depend on the carrier. Risk of loss passes to you when the package is handed to the carrier, though we will help you work with the carrier on a lost or damaged shipment.

7. Returns and refunds

Because most items are single, collectible cards, all sales are final unless a card arrives damaged in transit or materially not as described. If that happens, contact us within 7 days of delivery with photos and we will make it right through a replacement, refund, or store credit at our discretion. Break spots are non-refundable once a break has started, as described above.

8. Email and text messages

If you join our list or opt in at checkout, you agree that we may send you marketing messages. You can unsubscribe at any time using the link in our emails or by contacting us. Message and data rates may apply to any texts. Messages about your specific orders are not marketing and may still be sent.

9. Affiliate links

Some pages link to third-party products, for example supplies on Amazon. As an Amazon Associate, CardBoard may earn from qualifying purchases. These links do not change the price you pay.

10. Intellectual property

The Site, including its text, logos, the CardBoard name and wordmark, graphics, and layout, is owned by us or our licensors and is protected by law. You may not copy, resell, or use our content or marks without our written permission. Card images may show manufacturer trademarks owned by their respective owners, used only to describe the specific card offered.

11. Acceptable use

You agree not to use the Site to break the law, infringe anyone else’s rights, interfere with the Site’s operation, attempt unauthorized access, or use bots or scripts to buy inventory or break spots. We may suspend or cancel orders and access for conduct we reasonably believe violates these Terms.

12. Third-party services

We rely on third parties, including Shopify for our store and checkout, payment processors, shipping carriers, and streaming platforms such as TikTok for live breaks. Your use of those services may be subject to their own terms and privacy practices, which we do not control.

13. Disclaimers

The Site and our products are provided on an "as is" and "as available" basis. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that any card or break will achieve any particular value.

14. Limitation of liability

To the fullest extent allowed by law, CardBoard and Joy Holdings LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Site, any order, or any break. Our total liability for any claim will not exceed the amount you paid for the order or spot that gave rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless Joy Holdings LLC (dba CardBoard) and its owners from claims, losses, and expenses arising out of your misuse of the Site or your violation of these Terms.

16. Governing law and disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. You agree that any dispute relating to these Terms or the Site will be brought in the state or federal courts located in Missouri, and you consent to their jurisdiction, except where prohibited by law.

17. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, and the "Last updated" date above shows the latest revision. Your continued use of the Site after changes are posted means you accept them.
